He is technically correct, Actually I misspoke, Jim Hinken is correct that these laws apply to tax-paid alcohol, not homebrew. I'm not sure that there ARE shipping laws that apply to homebrew specifically, just non tax-paid alcohol. Anyway, I think my point was (and I say 'I think' because I was really tired when I wrote that) that while it may violate their policy, really, what is UPS going to do? Forbid you from shipping with them anymore? That would suck, but it's not the worst that could happen. Say you ship non tax-paid beer from WA to OR. You may have violated a state law or two, illegal importing or something. That's if you use UPS. If you ship via USPS, tax-paid or not, you have violated federal law. That's in addition to the state law that you broke. So, one or two state laws is better than one or two state PLUS a federal, right? And these are states WITH a reciprocal agreement. What happens when we ship beers to MD for the NHC? I don't even want to think about it. I don't know what to do about it though. One idea is to have each competition pay duty on the beer it receives for evaluation. This should really be a nominal fee, but would likely require new legislation. I'll leave it to others to decide if this is a half decent idea, or not at all Scottish. Part of me says leave well enough alone, while part would prefer this were all legal. Tom Schmidlin Again, really tired, and not a lawyer btw. ********************************************************************** * JudgeNet - the beer judge digest * * Send plain text only, no HTML, MIME, encoded text or attachments * * Manage your subscription online: http://synchro.com/judge * * Send subscription requests & changes to judge-request`at`synchro.com * ********************************************************************** ---------------------------------------------------------------------- From: David Houseman Date: Tue, 19 Apr 2005 08:03:10 -0400 Subject: Local Competition Press Releases?
